How a transfer with attorney escrow works

Attorney escrow protects both parties — the buyer won't lose their money and the seller won't lose the property. The whole process usually takes 20 to 30 days.

Drafting and signing the contracts

I prepare both the purchase agreement and the attorney escrow agreement. At a meeting in my office or at another agreed place, I verify the signatures of both parties on the purchase agreement and, if a mortgage is used, also on the agreement establishing the lien.

Depositing the purchase price into escrow

The buyer pays the purchase price into a separate attorney escrow bank account. The funds are kept apart from my own funds and those of other clients, and the bank notifies both parties of their receipt by email. The bank also sends an automatic email about any movement on the account, for maximum transparency and security.

Filing the registration application

No later than the next business day after the purchase price is credited, I electronically file the application for registration of ownership in the Land Register via a data box.

Paying the purchase price to the seller

Once the Land Registry completes the registration and I verify a "clean" title deed, I pay the purchase price to the seller — no later than the next business day. The transaction is then complete.

  • A separate bank account for each escrow. Your money is kept apart from my funds and those of other clients.

  • Before accepting money into escrow, I notify the bank of the email addresses of both parties, to which the bank sends information about account movements.

  • I report the attorney escrow to the Czech Bar Association before accepting the funds. The buyer sends the money only once the escrow notification has been confirmed by the Bar Association.

  • The escrow is covered by both the Deposit Insurance Fund and the Guarantee Fund of the Czech Bar Association.
